Handle: an extraordinary trial to industrial tribunal for former employees of the Aim slaughterhouses

Outstanding trial by the number of complainants: 194 ex-employees of the AIM slaughterhouses in Sainte-Cécile (Manche), near Villedieu-les-Poêles, dispute their 2018 licensees before the Avranches Prudranches Council.

Élise Brand is the lawyer for ex-employees.She had assisted them in the procedure for the takeover of the AIM group slaughterhouse in 2015.Some 230 employees had thus escaped unemployment by investing part of their dismissal allowances in the company Nouvelle Aim Group.

Faced with the four magistrates of the Prud'hommes Council, Élise Brand pleaded "the nullity of the layoffs", the job safeguard plan (PSE) having been "modified and not approved" by the administration after the layoffs intervened atfrom July 23, and non-compliance with the conventional external reclassification obligation.

And apart from this sector of activity, only one company was requested, "a tire assembly company with less than 50 employees 139 km from Sainte-Cécile".

For the lawyer for the ex-employees, the legal representative did not make his job upstream of the dismissals to promote reclassifications.

The defense disputes the nullity of layoffs and argues the "incompetence" of the council on the obligation of reclassification: "We already have a final decision on the PSE and the search for reclassification.The Council of State dismissed the ex-employees on this point after the judgments rendered by the administrative court of Caen and the Nantes court of appeal.

Through this collective procedure, Me Brand claims 74,000 euros for each employee, including 60,000 euros for damages for abusive dismissal.She underlined the lack of taking into account social risks: two employees committed suicide.At the hearing, one of the widows, Claudine, was present with one of her daughters:

At the end of four hours of hearing, the industrial tribunal put its judgment under deliberation at the hearing on June 27.
